Based in Shanghai, and reporting to Legal Director, China Mainland, you will be leading a small team which primarily responsible for all legal matters supporting e-commerce operation, data security initiatives, digitalization efforts and supply chain management. Your work scope includes:
• Provide legal guidance on e-commerce operations, including market places' and own channels' T&C, privacy notices, and compliance with consumer protection laws.
• Assist in the negotiation and drafting of contracts with third party platforms, operation service providers, payment processors, and logistics providers.
• Ensure compliance with data protection laws and regulations relating to customer data and e-commerce transactions.
• Develop and implement data security policies and procedures to protect sensitive information.
• Conduct risk assessments and provide legal advice on data breaches and incident response.
• Support the companys digital transformation strategy by advising on legal implications of new technologies, platforms, and tools.
• Review and negotiate software licensing agreements, technology partnerships, and digital service contracts.
• Collaborate with tech and cybersecurity teams to ensure legal compliance in technology implementations.
• Provide legal support for supply chain operations, including procurement contracts, vendor agreements and logistics arrangements.
• Advise on compliance with international trade laws, import/export regulations, and product liability issues.
• Assist in resolving disputes with suppliers and logistics providers.
• Design and conduct training to employees on legal compliance matters related to e-commerce, data security, and supply chain.
• Develop and update company policies and legal review processes related to data and privacy protection.
• Monitor changes in laws and regulations that may impact the company's operations and advise on necessary adaptations.
• Other ad hoc work assigned from time to time.
• Bachelor's degree or above in law from an accredited law school.
• Qualified PRC lawyer.
At least 12 years PQE with relevant experience gained in a reputable law firm or in-house environment, preferably within the retail or e-commerce industry.
• Excellent communication skills in English and Mandarin, both written and oral.
• Excellent knowledge of e-commerce business related laws and regulations.
• Strong background in commercial law, data protection regulations, and the legal aspects of digital transformation in the retail sector.
• With strong business acumen, good interpersonal skills, able to communicate effectively at all levels, and be a good team player.
• Strong analytical skills, detailed-minded and ability to work independently.
