A day in the life:
Based in Shanghai, and reporting to Senior Legal Counsel, China Mainland, you will, by interacting with P&C partners, other Legal team members and external counsels, be primarily responsible to provide best-in-class labor & employment support. Your work scope includes, but is not limited to:
- Counselling extensively and promptly on legal enquiries on daily operations of P&C teams, rendering thoughtful, intentional and innovative advice.
- Responsible for all contracts and legal documents review requests originating from P&C and its commercial engagements. Moreover, creating, expanding and maintaining legal templates so concerned, ensuring good implementation and application of the same in P&C operations.
- Working closely with P&C and other functions concerned to align, improve and enhance various operational procedures and guidelines, policy revamp and risk escalation process, to improve efficiency and maintain satisfying compliance level under evolving business.
- Together with P&C, compliance and cross-functional partners and if necessary collaborating with Global teams as well, updating employment rules and regulations, e.g. employee handbook, working rules, leave policy, bonus/reward/discipline policy to ensure the latest legislation and compliance requirements thereof are followed across organization.
- Providing legal training/workshop to P&C teams or employees over employment topics to align practice, update legal development and enhance awareness.
- Supporting and collaborating with P&C, GA and/or other teams on employment regulatory matters or inspections from government authorities.
- Handling arbitrations/litigations of labor disputes, including evidence discovery, case analysis and set-up of claim/counterclaim strategy, court hearing and summary, using assistance from external counsel and managing them properly.
Moreover, wrapping up takeaways and discussing learnings and action plans with P&C and assisting with implementation thereof.
- Collaborating with other legal team members as a team on cross-functional projects and initiatives, also assisting carrying out projects owned by other business teams where employment legal support is needed.
- Closely monitoring new legislation and regulatory enforcement in the market, alerting its potential impact to business with feasible action proposal. If necessary, also collaborating with compliance colleagues in employment related compliance projects and initiatives.
- Maintain regular communication over employment and compliance with legal teams of Global and other Region, assisting global policies and documents’ review as needed from time to time.
- Other ad hoc work assigned from time to time.
Qualifications:
- Bachelor’s degree or above in law.
- Qualified PRC lawyer.
- At least 8 years PQE with relevant experience gained in a reputable law firm and/or in-house environment where employment a major focus.
- Experience in compliance or litigation an advantage.
Must haves:
- Excellent communication skills in English and Mandarin, both written and oral.
- Excellent knowledge of labor/employment laws and regulations.
- Experience in managing labor-related projects and lawsuits.
- Knowledge in employment operation and compliance work so related.
- With strong business acumen, good interpersonal skills, able to communicate effectively at all levels, and be a good team player.
- Strong analytical skills, detailed-minded and ability to work independently.
